Sony Electronics’ Xperia Film Festival Contest
OFFICIAL CONTEST RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. Open and offered only to students of Academy of Art University holding a valid student ID in 2019, who are legal residents of the 50 United States or DC and who are at least 18 (AL & NE, 19+) years of age at time of entry AND CONTEST PERIOD. INTERNET ACCESS IS REQUIRED FOR PARTICIPATION. A PURCHASE WILL NOT ENHANCE YOUR CHANCES OF WINNING. THIS CONTEST IS INTENDED FOR PARTICIPATION IN THE U.S AND DC (EXCLUDING TERRITORIES) ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND/OR DO NOT AGREE TO THESE OFFICIAL RULES.

1. THE CONTEST:

Open and offered only to students of Academy of Art University (San Francisco, CA) holding a valid 2019 student ID, who are legal residents (including those holding an F1 full-time student Visa or H1-B Visa) of the 50 United States or DC and who are at least 18 (AL & NE, 19+) years of age at time of entry and Contest Period. This is a skill contest (“Contest”) in which a combination of judging and public voting will be used to determine participation and then overall winners. The overall Contest starts July 3, 2019 at 12:00:01 P.M., Pacific Time (“PT”) and ends August 12, 2019 at 3:00:00 P.M. PT (“Contest Period”). Within this overall Contest Period, the Contest will be conducted in two (2) Phases as described further, an Application Phase after which Semifinalists will be determined followed by a Video Submission Phase for the Semifinalists. Overall winners will be announced at the Xperia Film Festival event at San Francisco’s Union Square on August 14, 2019 and winners must be present to win. Sponsor’s computer is the official clock for the Contest. Void in Puerto Rico and where prohibited by law.

2. CONTEST PERIODS:

The Contest Period will consist of multiple phases as follows:

3. HOW TO PARTICIPATE:

PHASE 1 – APPLICATION PHASE:
STEP 1: Entrant must complete the form located at https://xperiafilmfest.com (“Contest Site”) by providing the following:

  • Name, address, student ID number, email address, phone number, link to portfolio and 1 minute video
  • A video (no more than 1 minute in length) reflecting the entrant’s creativity on any subject (excluding inappropriate subject matter as described in Section 4 of these Official Rules);
  • A biographical essay (no more than 200 words in length) about the entrant.

All submitted materials, including, without limitation, the photos and/or video files and entry become the property of Sony and will not be returned to entrant (collectively “Applications”). Entrant should retain and store the original versions or formats of the Submissions. Applications submitted consistent with these Contest Rules and as determined by the Sponsor’s judges may be displayed on the Contest Site, on other Sony websites, and at the Xperia Film Festival, excluding details of entrant’s personal contact information.

All Applications will be initially reviewed by the Sponsor judging panel for compliance with these Official Rules.  Thereafter, the judges will “score” each of the Applications then deemed eligible, based on the following criteria:

  • Creativity – 50%
  • Quality of composition – 25%
  • Overall appeal – 25%

Each Application will, for each of the above-described criteria, be scored by the judging panel with a raw score between 1-5 (with 5 being the highest). For each Application, after a (1-5) score has been determined for each criterion, each raw score will be “weighted”, taking into account the relative percentages shown above next to each criterion.  The “total score” for each scored Application will be the total score of all of the above criteria (taking into account the above-described “weighting”).  The twenty-five (25) Applications having the highest “total score” will proceed to Phase 2 (described more fully below) and, at that point, each entrant associated with each of such twenty-five (25) Applications will be deemed a semifinalist (“Semifinalist”). The Semifinalists will be notified via email. Potential Semifinalists must respond to Sponsor’s notification with twenty four (24) hours of the email communication to confirm participation as a Semifinalist. Failure to respond in this time period may result in disqualification and the selection of an alternate.  Applicants should regularly check their email for communications regarding the Contest.

The Sponsor reserves the right, in its sole discretion, to select fewer than twenty-five (25) Semifinalists (if, for example but without limitation, an insufficient number of eligible Submissions are received).

NOTE:  In the event of a tie in Phase 1, an additional judge will score each tied Application (pursuant to the procedures described above) and the Application with the highest total score pursuant to that subsequent scoring will proceed to Phase 2.  In the event of a further tie as to Phase 1, the judges shall, in their sole discretion, choose a Semifinalist(s) based on its evaluation of which Application is superior overall, taking the entire judging criteria into consideration.

PHASE 2: VIDEO SUBMISSION PHASE FOR SEMIFINALISTS:

After the Semifinalists have been determined on July 18, 2019 the Sponsor will loan out to each Semifinalist one (1) Sony Xperia 1, for their use in creating their Video Submission, subject to Rule 11 below. NOTE: At the end of Phase 2, all Semifinalists must return the Sony Xperia 1 to Sponsor which has been on loan to them. The Video Submissions must be uploaded to https://xperiafilmfest.com no later than 11:59:59 PM PST on August 2, 2019.

With regard to Phase 2, judges will “score” each of the Video Submissions then deemed eligible, based on the following criteria:

  • What one of the following words means to entrant: Joy, Wonder or Kando (40%)
  • What attending the Xperia Film Festival would mean to entrant (27%)
  • Creativity/originality of Submission (33%)

The Video Submission will be viewed by the public on the Contest Site and the public will be able to vote for their favorite Semifinalist Video Submission.  Sponsor is not responsible for any technical and/or quality issues of any Video Submission uploaded to the Contest Site, it being understood that the Video Submission displayed as the Semifinalist Submission on the Contest Site may differ from what was submitted by the Semifinalist due to technical limitations or other reasons. Video Submissions will be attributed based on the official names of the respective entrant (relating to each Semifinalist Submission). The Video Submissions will be displayed on the Contest Site in a format/pattern/sequence of Sponsor’s sole choosing, and may be rotated one or more times during the Public Voting Period (defined below). Public voting will begin at 12:00:00 PM PST on August 5, 2019 and end at 3:00:00 PM PST on August 12, 2019 (the “Public Voting Period”).  However, by posting notice to such effect on https://xperiafilmfest.com, Sponsor may reschedule, postpone or modify the term of the Public Voting Period. Finalist will receive one (1) vote each time a person selects their Video Submission.  Limit one (1) vote per day per IP Address for the entire Public Voting Period. Only one (1) Semifinalist video Submission may be selected per vote.

The voting is open to persons who are legal U.S. residents currently residing in the 50 United States or DC who are at least thirteen (13) years old.  All votes are subject to final verification by Sponsor.  Sponsor has the right to void any votes that, Sponsor deems in its sole discretion, are received fraudulently, not submitted in accordance with the spirit and letter of these Official Rules or via the use of automated software. Any posting of votes received by a given Semifinalist Submission (including but not limited to on a leaderboard or ranking of any kind) on the Website or elsewhere is intended for informational purposes only and may be modified by Sponsor without notice or liability based on the validation of votes; and, as such, any posting of vote totals is in no way binding upon Sponsor.

After the Public Voting Period has concluded, to determine the Grand Prize Winner, the Phase 1 “raw score” tabulations for each Semifinalist will be re-used to allow, by also taking into account the results of the public vote, a “Phase 2 Total Score” to be determined.  Such “Phase 2 Total Score” will be determined by “weighting” the Phase 1 scores for each of the above-listed criteria (using the relative percentages tabulated below), then “weighting” the results of the public vote (which, as indicated below, will carry a relative “weight” of 50%), and adding all of the above (in this paragraph) together to arrive at each Finalist’s “Phase 2 Total Score”.

The Semifinalist with the highest Phase 2 Total Score will be deemed the Grand Prize Winner. The Finalist with the second highest Phase 2 Total Score will be deemed the First Place Winner. The Finalist with the third highest Phase 2 Total Score will be deemed the Second Place Winner.

In the event of a tie, an additional judge (solely selected by Sponsor) will re-score each tied Semifinalist Submission (pursuant to the Phase 1 judging criteria) and the Semifinalist Submission with the highest total  score will be deemed the potential Grand Prize Winner.  In the event of a further tie, the Sponsor in its sole discretion shall choose the potential Grand Prize Winner from the tied Semifinalist Submissions based on an evaluation of which Submission is superior overall, taking the entire judging criteria into consideration. Sponsor shall have no duty or obligation to release results of scoring, identity of judges, or justification of results.

4. VIDEO SUBMISSIONS REQUIREMENTS:

Video Submissions: (i) may not have been commercially available; (ii) may not have won or have been previously submitted to Sony or to any other contest, including third party contests; (iii) must be the exclusive original work of the Entrant and made for the Contest; (iv) may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by Sony in its sole discretion; (v) must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by Sony in its sole discretion; (vi) may not violate or encourage others to violate any applicable law, statute, ordinance or regulation; (vii) may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights; (viii) may not contain commercial or corporate advertising, including but not limited to corporate logos, brand names and slogans, other than those relating to Sony; (ix) may not include any website URLs, viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code or content that may harm or compromise the proper conduct of the Contest; (x) may not use any watermarks or distinguishing artist marks (such as signatures); (xi) must be in the English language or accompanied with an English translation of the audio or visual text; and (xii) if found to be in violation of these Contest Rules will be disqualified and therefore removed from the Contest Site.

By making a Video Submission, entrant represents that (i) entrant has the unrestricted right to submit the entry; (ii) all persons whose name, or likeness appears in the Submission (“Entry Participants”) have unconditionally consented, in writing, the right to their name or likeness in the entry and unconditionally granted entrant, in writing, the right to submit the entry subject to these Contest Rules, a copy of such writing will be furnished to Sony upon request; and (iii) the entry does not infringe upon any third party’s proprietary or other rights. No damaged, incomplete, forged or appropriated entries will be accepted. Entrants may enter a maximum of one (1) entry.  All Submissions become the property of Sony.

5. PRIZES AND APPROXIMATE RETAIL VALUES (“ARV”):

Place winners will be featured at the Xperia Film Festival event on San Francisco’s Union Square on August 13, 2019 where the top three (3) winners will be announced. Winners must be present at the Xperia Film Festival to win.

  • One (1) Grand Prize winner will receive a check for $10,000.
  • One (1) First Place winner will receive check for $2,500.
  • One (1) Second Place winner will receive a check for $1,000.

Total ARV Contest prize package $13,500. The ARV is in US Dollars and represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed.

NOTE: The Grand Prize, First and Second Place winners must complete an Affidavit of Eligibility/Liability/Publicity Release and an IRS Form W-9 (collectively “Affidavit”) as a condition of being named a confirmed winner and awarded any prize. The potential winners will be contacted between 3-5 PM PST on August 12, 2019 and provided with the Affidavit. Potential winners must complete and return the Affidavit no later than midnight on August 12, 2019. Failure to do so may result in disqualification.

Lodging, air or ground transportation associated with attending the Xperia Film Festival are NOT included. All federal, state and local taxes and fees associated with the prize receipt and/or use, if any, are solely the responsibility of winner. The winner will be responsible for paying all costs and expenses related to the prize that are not specifically mentioned herein, including but not limited to, taxes, lodging, transportation, food and beverages, gratuities, incidentals, parking, telephone charges and any other expenses that might reasonably be incurred by winner in receiving or using the prize.

IMPORTANT: Sony has no responsibility for a winner’s inability or failure to accept or utilize a prize as described herein. All prizes in this Contest are nontransferable, non-assignable and non-substitutable except that Sony may, at its sole discretion, substitute a prize or any component thereof with one of equal or greater value. Additionally, the winners may each receive a Form 1099 or other document in the amount of the actual value of the prize, as required by law. Persons under the age of 18 years (AL & NE, 19+) (as of the date of entry) are not eligible to enter or win the Contest.

If a potential winner is found to be ineligible, is not in compliance with these Contest Rules, does not respond to the phone call or e-mail in a timely manner, is disqualified or forfeits prize for any reason, declines to accept the prize, or if the prize notification or prize is returned as undeliverable, Sponsor reserves the right to award the prize to an alternate entrant who will also be selected per the judging criteria from all remaining non-winning entries received during the Contest Period. If after a good-faith attempt Sponsor is unable to award or deliver a prize, the prize will not be awarded.

6. ELIGIBILITY:

Open and offered only to students of Academy of Art University (San Francisco, CA) holding a valid 2019 student ID, who are legal residents (including those holding an F1 full-time student Visa and a H1-B Visa) of the 50 United States or DC and who are at least 18 (AL & NE, 19+) years of age at time of entry and Contest Period, and excludes officers, directors, and employees (and members of their household and of their immediate families, i.e., parents, children, stepchildren, spouse, siblings, “step” of each and persons residing in the same household of such immediate family members) of Sony, its subsidiaries, affiliates, sales representatives, distributors, advertising/Contest/web design agencies, faculty and staff of Academy of Art University, and/or their affiliates, assigns or representatives; (hereinafter referred to collectively as “Sony & Others”), and all other persons or entities associated with the development, administration, Contest, execution of, or supply to this Contest.

7. RELEASE:

By acceptance of a prize, the winner releases Sony & Others, from and against any and all liability and claims or causes of action, including, but not limited to, personal injury, death, or damage to or loss of property with respect to all aspects of this Contest, including those arising out of participation in this Contest, any prize related activity whether sponsored by Sony & Others or third parties, or the acceptance or possession or use/misuse of the prize or any component of the prize.

8. LIMITATIONS OF LIABILITY/INTERNET:

Sony & Others are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, typographical, mechanical or electronic or for any damage to any person’s computer related to participating in the Contest. Sony & Others are not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical, typographical or human errors which may occur in the processing of any entries in this Contest. Any entrant who attempts to interfere with the proper play of this Contest will be disqualified from participation in the Contest. Persons found tampering with or abusing any aspect of this Contest, as solely determined by Sony, will be disqualified and may be subject to prosecution. If in the judgment of Sony, the Contest is compromised by viruses, bugs, non-authorized human intervention or other causes beyond the control of Sony, which corrupt the administration, security, fairness or proper play of the Contest, Sony reserves the right, in its sole discretion to discontinue, modify, suspend or terminate the Contest and proceed in a manner it deems fair and reasonable, including the selection of winners from among eligible entries received prior to such discontinuation, modification, suspension or termination. Any personally identifiable information collected during an entrant’s participation in this Contest will be collected by Sony and used by Sony and its agents solely for purposes of the proper administration and fulfillment of the Contest as described in these Official Contest Rules or as stated in Sony’s Privacy Policy at http://products.sel.sony.com/SEL/legal/privacy.html (for residents of US).

ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SONY RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a potential winner based on an email address, the winning entry will be deemed to have been made by the Authorized Account Holder of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. SONY MAKES NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.

9. DISPUTES:

Issues concerning the construction, validity, interpretation and enforceability of these Official Contest Rules shall be governed by the laws of the State of Delaware, United States. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action. Should there be a conflict between the laws of the State of Delaware and any other laws, the conflict will be resolved in favor of the laws of the State of Delaware. All judgments or awards shall be limited to actual incurred out-of-pocket expenses (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.

10. GENERAL:

By participating in the Contest, entrants agree to these Contest Rules and the decisions of Sony, which are final and binding in all matters and all respects relating to this Contest. This Contest is void in Puerto Rico and wherever else prohibited by law.

By participating in the Contest and providing the Submissions to the Sponsor in connection with the Contest, each entrant shall retain all right, title and interest (including copyright) in and to the Submission, and upon submission of an application grants to the Sponsors and their respective successors, assigns and licensees a worldwide, gratuitous, irrevocable, exclusive and fully paid up license to copy, use, modify, reproduce, display, adapt, amend and transmit the Submissions for commercial purposes including without limitation, advertising and promotional purposes as well as in, on or in connection with the Submissions, the Contest or other promotions in all media now known or hereafter devised in perpetuity beginning on the date of entry, and hereby releases the Sony & Others, and their respective successors, assigns and licensees from any liability with respect thereto. Acceptance of a prize constitutes the winner’s consent to the use of her name, biographical information, photograph, and/or likeness for advertising and publicity purposes as determined by Sony or its designees without further compensation, except where prohibited by law. All federal, state and local laws and regulations apply. Sony & Others are not responsible for any entries and/or entries that are lost, late, undelivered, misdelivered or postage due mail.

11. SONY XPERIA 1 PRODUCT LOAN:

With regard to the Xperia product loan to Semifinalists as set forth in Rule 3 above, Sony loans Sony Xperia 1 to Semifinalist for a term set forth at the time of the product loan. Upon the expiration of the term, Semifinalist will return Sony Xperia 1 to Sony as instructed. Use of the Sony Xperia 1 is subject to Semifinalist paying all costs and expenses related to the data and messaging rates from Semifinalist’s carrier that may apply. Upon return of the Sony Xperia 1 to Sony, Semifinalist is responsible for deleting all data on the product from usage during the loan. Sony will not be able to retrieve data from the Sony Xperia 1 under any circumstances whatsoever.

Semifinalist agrees to return Sony Xperia 1 to Sony undamaged and in good working order.

IF A SEMIFINALIST DOES NOT RETURN PRODUCT(S) AT THE CONCLUSION, OF IF THE RETURNED PRODUCT IS DAMAGED DUE TO ABUSE, MISUSE, ALTERATION, MISSING PARTS/PIECES, NEGLECT OR SHIPPING, ETC. SEMIFINALIST AGREES TO PAY SONY, WITHOUT FURTHER DEMAND OR NOTICE, THE FULL ACTUAL RETAIL PRICE OF THE SONY XPERIA 1 AND ON THE TERMS AND CONDITIONS THAT SONY SELLS PRODUCT(S), OR PRODUCTS LIKE THEM, TO OTHER CONSUMERS.

Semifinalist agrees and acknowledges: (1) that right, title and interest to Sony Xperia 1 is and will at all times remain with Sony and in Sony’s name while in Semifinalist’s care, custody and control. Neither Semifinalist, nor its heirs, successors or permitted assigns, including any successor in bankruptcy, shall have any title or other legal interest in Sony Xperia 1 nor represent to any third party that Semifinalist is the owner of Sony Xperia 1; (2) that Semifinalist has no right to transfer any interest in Sony Xperia 1 ; (3) Sony Xperia 1 may not be sold, leased, mortgaged, or otherwise hypothecated; and (4) at all times, including in the event of bankruptcy or any other claim by a third party with reference to any interest in Sony Xperia 1 , Sony shall have the right, without liability for trespass, to repossess Sony Xperia 1 .

DISCLAIMER OF WARRANTIES: SONY MAKES NO WARRANTIES WHETHER EXPRESSED OR IMPLIED, WITH REGARD TO SONY XPERIA 1. ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED. ALL IMPLIED WARRANTIES AGAINST INFRINGEMENT ARE EXPRESSLY DISCLAIMED.

12. WINNERS LIST:

The names of the winners will be posted on https://xperiafilmfest.com until about October 31, 2019.
